Arman Muis Undergoes Open Doctoral Law Exam at UNPRI

The Doctoral Law Study Program, Faculty of Law, Universitas Prima Indonesia (UNPRI) held an Open Defense Examination for Arman Muis, Student ID Number 223309052007, Thursday, May 22, at the Main Hall, 10th Floor, UNPRI Campus, Jl. Sampul No. 3 Medan.

The open defense was led by Vice Rector III UNPRI Refi Ikhtiari, S.Si., M.Sc., Ph.D, attended by Vice Dean I Dr. Herman Brahmana, S.H., M.H, promoter Prof. Dr. Teguh Prasetyo, S.H., M.Msi, co-promoter Dr. Elvira Fitriyani Pakpahan, S.HI., M.Hum, examiner Prof. Dr. Tommy Leonard, S.H., M.Kn, examiner Brigadier General Pol (Ret.) Dr. Drs. Yasdan Rivai, M.Hum, external examiner Dr. Said Rizal, S.H.I., M.A. The law was guided by Dr. Rizki, S.H., M.Kn as moderator

In the open session attended by approximately 250 people, Arman Muis explained his dissertation entitled "URGENCY OF IMPLEMENTING BUSINESS AND HUMAN RIGHTS BASED ON DIGNIFIED JUSTICE FOR WORKERS IN THE MAKASSAR INDUSTRIAL AREA".

Arman Muis raised the issue of how workers' rights are derived from the positive legal system in Indonesia, how weaknesses are in implementing workers' rights in business actions in the Makassar Industrial Area, how legal protection for workers is in implementing business in the Makassar Industrial Area based on dignified justice.

Arman Muis put forward the Grand Theory of Dignified Justice as a Grand Theory (Teguh Prasetyo), the Legal System as a Middle Theory (Lawrence M. Friedman) and Legal Protection as an Applied Theory (Philipus M. Hadjon).

Arman Muis also explained the weaknesses in the implementation of workers' rights in business actions in the Makassar Industrial Area, as well as legal protection for workers in the Makassar Industrial Area. As well as efforts to improve legal protection and the application of the principle of dignified justice in business.

Arman Muis concluded that the derivation of workers' rights in the positive legal system in Indonesia includes various rights guaranteed by laws and regulations to protect the welfare and dignity of workers. These rights include the right to a decent wage in accordance with the Provincial Minimum Wage (UMP) and Sectoral Minimum Wage (UMS) based on the Job Creation Law No. 6 of 2023, the right to social security through BPJS, the right to occupational safety and health (K3) in accordance with Law No. 1 of 1970, the right to leave and rest time regulated in the Job Creation Law, the right to associate guaranteed in Law No. 21 of 2000, the right to protection from Termination of Employment (PHK) with compensation in accordance with applicable regulations, and the right to be free from discrimination.

Weaknesses in the implementation of workers' rights in business actions in the Makassar Industrial Area include several aspects, such as weak labor supervision, low company compliance with labor regulations, and limited worker access to industrial dispute resolution mechanisms. One of the main problems is that there are still many companies that do not provide wages in accordance with the provisions of the Provincial Minimum Wage (UMP) or delay payment of workers' salaries. In addition, the non-transparent work contract system is also an obstacle, where many workers are contracted repeatedly for short terms without certainty of permanent work status, which results in weak protection of their rights.

Legal protection for workers in the implementation of business in the Makassar Industrial Area based on dignified justice is an effort to ensure that every worker gets their rights in accordance with fair and humane labor standards. The principle of dignified justice requires that workers are not only viewed as a means of production, but as subjects who have fundamental rights that must be protected.
