Unpri Students Learn Civil Dispute Resolution
The process of resolving civil disputes as one of the parts of the law faculty, students of the University of Prima Indonesia (Unpri) were given a lecture by the Chief Justice of the Medan District Court (PN) H Ahmad Shalihin SH MH. "For an understanding of this, we specifically invite the Chief Justice of the Medan District Court as a resource person to convey the process in the trial to law faculty students," said Dean of FH Unpri Dr Tommy Leonard SH MKn on campus, Monday (23/5).
According to him, Indonesia is a country that places law as the highest supremacy of power in the life of the nation and state. "So the concept of a state of law in the nation and state, brings the necessity to reflect the joints of life, especially in the field of civil procedural law related to the resolution of civil disputes," he said.
He said that the dispute was intended as the emergence of differences in interests in the form of differences in civil rights and obligations regulated in material civil law which always goes hand in hand with formal civil law or others referred to as civil procedural law. In principle, he said, in resolving civil disputes, the court is not the only institution to resolve disputes. However, out-of-court dispute resolution is also known.
He explained that the courts are still the Last Resort in resolving disputes, although it is not the only way that can be taken. "The advantage of resolving disputes through litigation in court is that it is adjudicative by giving a decision on a dispute, so it can provide legal certainty," said Tommy.
Medan District Court Chief Justice H Ahmad Shalihin at a seminar themed 'Civil Dispute Resolution in the District Court' explained the procedures for filing and the contents of the lawsuit, matters relating to the lawsuit letter and the lawsuit registration process until the summons for trial. Ahmad Shalihin also explained the process during the trial, especially during mediation and reading of the lawsuit. At the first trial the judge checks the attendance of the parties. If the lawsuit and the defendant are not present, even though they have been properly summoned, then the judge can issue a default verdict.
Before deciding a case, he said, the chairman and members of the panel of judges study the files in turns. Next, determine the date of the deliberation and submit opinions and arguments to support their respective opinions, starting from the facts of the case, evidence from the parties, the law and the final opinion of the panel of judges on the contents of the verdict. The public lecture was attended by the Rector of Unpri Prof. Dr. Djakobus Tarigan AAI. DAAK, Head of the Planning and Development Institute Yusriando SH MH, and Head of the Unpri FH Study Program Elvira Fitriani Pakpahan SH MHum.
The public lecture was combined with the signing of the extension of the MoU between FH Unpri and the Medan District Court.
