Supreme Court Judge Gives Public Lecture at FH UNPRI

Faculty of Law, Prima Indonesia University (UNPRI) held a public lecture on Friday, February 24, 2023 at the Main Hall of the UNPRI Main Campus, Jalan Sampul 4, Medan City. The Public Lecture with the theme "Are Judges Still God's Representatives in the World" presented Legal Expert Dr. H. Haswandi, S.H., S.E. , M.Hum., M.M. (Supreme Court Justice of the Civil Chamber of the Supreme Court) as a speaker.

The public lecture was attended by, Prof. Dr. dr. I Nyoman Ehrich Lister, M.Kes., AIFO-K. ,AIFM.,Sp.KLLP, (founder of UNPRI), Dr. Tommy Leonard, S.H.,M.Kn (Chairman of the BPH Foundation of Higher Education of Universitas Prima Indonesia), Chancellor of UNPRI, Prof. Dr., Chrismis Novalinda Ginting, M.Kes, Advisor to UNPRI Prof. Dr. dr. Farhat, M.Ked (ORL-HNS), Sp. ENT-KL (K) FICS, Vice Chancellor IV UNPRI, Dr. dr. Ali Napiah Nasution, M.K.T., M.K.M., Sp.K.K.L.P. Director of Royal Prima Medan Hospital, Dr. dr. Wienaldi, MKM, Director of Prima Vision Hospital, Muhammad Faris, Sp.BS, Dean of the Faculty of Law UNPRI represented by Deputy Dean I, Herman Brahmana, S.H., M.H. Professor of the Faculty of Law UNPRI, Prof. Roswita Sitompul, S.H., M.Hum., Ph.D, representatives of the study program heads, heads of institutions and heads of Bureau, representatives of the Dean and all staff, and around 200 UNPRI Faculty of Law students and academics.

In his speech, Deputy Dean I of the UNPRI Faculty of Law expressed his gratitude to the speakers who had taken the time to share their knowledge and experience. during his service as Chief Justice of the Civil Chamber of the Supreme Court. Herman hopes that this public lecture activity will be useful for FH UNPRI students whose graduate profiles are indeed narrowed down to three professions, lawyers, judges, and prosecutors. "The Faculty of Law really hopes that students will continue to improve their knowledge skills, especially in the field of the judge profession as speaker's expertise. The law provides enlightenment for those seeking justice, and the Supreme Court is the source of justice," said Herman.

The public lecture on Friday, February 24, 2023 was moderated by the Secretary of the Law Study Program, Rizki, S.H,M .Kn. In the opening of the public lecture, Dr. H. Haswandi, S.H., S.E., M.Hum., M.M stated that in essence, all sciences are the same, only the practice is different. Related to the context of legal science and specifically judicial practice, "the law in the book is not the same as the law in action," he said.

Looking at the topic of the public lecture, Dr. H. Haswadi said that society often assumes that judges are God's representatives in the world, this is related to the role of judges to produce justice. Justice must be owned, implemented, and upheld, in this case, the Supreme Court (MA) is the last bastion of the law enforcement process. in the Republic of Indonesia. He continued, he explained the practice of the duties and functions of the Supreme Court as a court of justice, different from the Constitutional Court (MK) as a legal court institution or court of law.

Supreme Court Civil Chamber Justice This also explains that case data that can be accessed by the public through the website is often misused by parties with malicious intentions, they read cases that have actually been decided and contact the disputing parties to hand over a sum of money to win the case, even though the case has been resolved. "Starting from entering the case, it can be sold," said Dr. H. Haswadi. To address data leaks or misuse of data, the Supreme Court strictly carries out honesty and integrity selection through cross-checking employees who will enter the Supreme Court with a profile assessment.

It is often found that cases are suddenly decided by judges without going through the process the courts, and these cases are in the public spotlight, and have an impact on the lack of public trust in the judicial system in Indonesia. "The verdicts fall from the sky, it is not clear what the considerations are, people suddenly win, suddenly lose. In fact, making a decision must be based on legal theory. Judges must be able to organize the issues, then the evidence," continued Dr. H. Haswadi, "Students who want to become prospective judges must be good at sorting issues, looking at the issues, then looking at the evidence."

Message from Dr. H. Haswadi to UNPRI students, making decisions must pay attention to several things, namely: 1. Legal justice, justice according to the law, maximum/minimum law, 2. Social justice, how is the justice of society, the law that develops in a region (values- values) 3. Philosophical side, especially Pancasila as the basis of the state. 4. Sociological side. 5. Historical side. 6. Legislation, laws and regulations.is something static, while legal values ​​are dynamic.

Ending the lecture session, the Chief Justice of the Civil Chamber of the Supreme Court explained the Supreme Court's efforts to restore the dignity of judges. These efforts are to maintain the integrity of all officers on duty through internal/external supervision (government, judicial monitors, NGOs). Furthermore, it is being planned to determine the panel technologically/robotically according to expertise, a system that minimizes the public's perception that the panel is ordered by the disputing parties. Responding to the case that is currently being discussed by the public, the Ferdi Sambo case, Dr. H. Haswadi believes that media trials through the mass media have indirectly disrupted the independence of judges.

The event continued with a question and answer session. Some discussion-inducing questions raised by UNPRI students include, what is the role of the Supreme Court as a legal advisor, the implementation of the death penalty for corruptors, efforts to increase public trust in the district/high courts so that there is no need to appeal to the Supreme Court and premeditated murder (the Sambo case) that the verdict has been considered fair but there is a possibility of an appeal/cassation and how consistent is the trial.
